T-Mobile, AT&T, Verizon, and other carriers are not responsible for the content of any messages sent through our service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results from our automation services, including but not limited to lead conversion rates, review generation, response times, or revenue increases.
You agree to indemnify and hold harmless HSP, its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or violation of any third-party rights.
We reserve the right to terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
